NOTICE IS HEREBY GIVEN, a City election will be held in the City of Roseburg, Oregon, on Tuesday, November 8, 2022. The election will be conducted by the Douglas County Election Department in accordance with the provisions of Chapter 254 of the Oregon Revised Statutes. The election is called for the purpose of voting on the following:

CAPTION: CONCERNING PSILOCYBIN-RELATED BUSINESSES WITHIN THE CITY OF ROSEBURG, OREGON

QUESTION: Shall the City of Roseburg allow psilocybin-related businesses in Roseburg?

SUMMARY STATEMENT: State law allows for the manufacture, distribution and possession of psilocybin and psilocin. State law provides that a city council can refer the question of prohibiting/allowing psilocybin to the voters. If adopted by the voters, this measure would allow the establishment of psilocybin product manufactures and/or psilocybin service center operators within the City of Roseburg. If not adopted by the voters, the establishment of psilocybin product manufactures and/or psilocybin service center operators will be prohibited within the City of Roseburg.

Elections in Oregon are conducted by Vote-by-mail. Ballots may be mailed or delivered to the Douglas County Clerk’s Office, or placed in drop boxes at locations selected by the Douglas County Clerk.

On or after October 20, 2022 , The City of Roseburg will submit a Request for Release of Funds (RROF) to the Oregon Business Development Department (OBDD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 as amended, for its housing rehabilitation program. The purpose of The City of Roseburg’s housing rehabilitation program is to use to perform repair and rehabilitation of existing single-family, owner-occupied units located in Cities of Roseburg, Myrtle Creek, and unincorporated portions of Douglas County. Annually, the program rehabilitates over 13 low- to-moderate-income homes with approximately $400,000 of CDBG funds.

Specific locations of individual units to be rehabilitated cannot be determined prior to the completion of the Area-Wide Environmental Review and the RROF. For the housing rehabilitation activities proposed The City of Roseburg is using a Tiered Environmental Review format and process proposed under HUD Regulations for the National Environmental Policy Act at 24 CFR Part 58.15.

In this first tier, a broad area-wide statutory review of the housing rehabilitation program has identified laws and authorities that we have determined will not be triggered by the location of the rehab program. These laws include: Floodplain Management (24 CFR Part 55 and Executive Order 11988), Wetland Protection (Executive Order 11990), Sole Source Aquifers (The Safe Drinking Water Act, 40 CFR Part 149), The Coastal Zone Management Act of 1972, the Wild and Scenic Rivers Act of 1968, The Clean Air Act, The Farmland Protection Policy Act of 1981, The Environmental Justice Executive Order 12898, The Noise Abatement and Control Standard (24 CFR part 51B), The Explosive and Flammable Operations Standard (24 CFR Part 51C) and Airport Clear Zones and Accident Potential Zones (24 CFR Part 51D).

In the second tier review, The City of Roseburg identified laws and authorities that must be analyzed with site-specific environmental review checklists for each property location. These laws include: Historic Preservation (36 CFR Part 800), Flood Disaster Protection Act of 1973, The Endangered Species Act (50 CFR Part 402) and Toxic Chemicals and Radioactive Materials (24 CFR, Part 58.5(i)).

An Environmental Review Record (ERR) that documents the environmental determinations for this project, along with a copy of The City of Roseburg policies and processes to be followed for site specific reviews, is on file, and may be examined or copied Monday through Saturday from 8 a.m. to 5 p.m. (closed noon-1:00pm) at Roseburg City Hall, 3rd Floor (900 SE Douglas Ave.). PUBLIC COMMENTS: Any individual, group, or agency may submit written comments on the ERR to the City of Roseburg (900 SE Douglas Ave.) or by email (cdd@cityofroseburg.org). All comments received by October 13, 2022 will be considered by the City of Roseburg prior to submission of a request for release of funds.

OBJECTIONS TO RELEASE OF FUNDS: OBDD will accept an objection to its approval of the release of funds and the City of Roseburg certification for a period of fifteen days following the anticipated submission date or actual receipt of the request for release of funds (whichever is later) only if they are on one of the following bases:

OBDD will accept objections to its Release of Funds only if they are based on one of the following:

A. The certification was not executed by the Certifying Officer of the City of Roseburg.

B. The City of Roseburg has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58.

C. The City of Roseburg has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by OBDD.

D. Another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58), and shall be addressed to OBDD at 775 Summer Street NE, Suite 200, Salem, OR 97301-1280. Objections to the release of funds on bases other than those stated above will not be considered by OBDD.

Potential objectors should contact OBDD to verify the actual last day of the objection period. It is estimated that any objection received after October 20, 2022 will not be considered by OBDD.

CITY OF ROSEBURG NOTICE OF PUBLIC HEARING ON THE PROPOSED WITHDRAWAL OF APPROXIMATELY 0.29 ACRES OF PROPERTY LOCATED ON HOUSLEY AVENUE, T27 R06 01DA TAX LOT 1601, FROM DOUGLAS COUNTY FIRE DISTRICT NO. 2

NOTICE IS HEREBY GIVEN that on Monday, October 10, 2022, the Roseburg City Council will hold a public hearing regarding the proposed withdrawal of approximately 0.29 acres of property located on Housley Avenue, from Douglas County Fire District No. 2. The hearing will begin at 7:00 p.m. in the City Hall Council Chambers, 900 SE Douglas in Roseburg. Adoption of an ordinance annexing the property to the City of Roseburg, changing the zoning and withdrawing it from Douglas County Fire District No. 2 will be considered following the public hearing on withdrawal.

The property involved in this annexation, zone change and withdrawal is further described as Tax Lot 1601, Township 27 South, Range 06 West, Section 01DA, Willamette Meridian. The proposed action will annex the property to the City; withdraw the same from Douglas County Fire District #2; and change the zoning from County R1 (Single-Family Residential) to City R7.5 (Single Family Residential).

At the public hearing, the Council will hear objections to the withdrawal and determine whether such withdrawal is in the best interest of the City. Written comments regarding the proposed withdrawal should be submitted to the City Recorder before 5:00 p.m. on Monday, October 10, 2022. All written and oral comments will be taken into consideration before a motion to proceed with the withdrawal at the time of annexation and zone change is considered. PUBLIC NOTICE OF SPECIAL SOLICITATION AND 
EXEMPTION APPROVAL PROCESS

NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Roseburg City Council on Monday, June 27 at 7:00 PM in the Council Chambers at 900 SE Douglas Avenue, Roseburg, Oregon regarding a Special Solicitation and Exemption Approval Process for the purchase of a Caterpillar Model 308 Mini Hydraulic Excavator.

Roseburg Municipal Code (RMC) Section 3.06.010 authorizes the City Council to exempt a special public contract from competition on making appropriate findings as outlined in RMC Section 3.06.035(B)(3). In addition, Roseburg Municipal Code Section 3.06.025(E) allows cooperative procurements to be made without competitive solicitation subject to the Oregon Public Contracting Code and Model Rules 137-046-0400.
